1. Service Description

StreamProfy provides AI-powered music industry networking tools ("AI Pitch Tools") that enable users to:

• Browse directories of playlist curators, record labels, YouTube channels, artists, beat buyers, and music festivals
• Generate AI-optimized pitch emails for music submissions
• Send individual or bulk contact requests to industry contacts
• Track pitch history and receive confirmation receipts

StreamProfy is a pitch facilitation service. We provide the platform and tools to create and send pitch communications. We do not guarantee any response, placement, signing, booking, or collaboration as a result of using our tools.

2. Credits & Payments

2.1 Credit System

• Credits are required to use the Bulk Contact feature
• Credits are sold in packs of 500 credits for $5.00 USD
• 1 credit = 1 contact pitch sent via Bulk Contact
• Individual pitches (non-bulk) do not require credits

2.2 Non-Refundable Policy

2.3 Chargebacks & Disputes

Filing a chargeback or payment dispute for credit purchases constitutes a breach of these Terms. In such cases, StreamProfy reserves the right to:

• Immediately suspend or terminate your account
• Revoke all credits and access to AI Pitch Tools
• Pursue recovery of the credited amount plus any associated fees

3. User Obligations & Anti-Spam Compliance

3.1 Acceptable Use

By using our AI Pitch Tools, you agree to:

• Send only legitimate, relevant music-related pitches
• Not use the tools for spam, harassment, fraud, or any illegal purpose
• Not send malicious links, adult content, or deceptive material
• Provide accurate information about yourself and your music
• Comply with all applicable anti-spam laws including CAN-SPAM Act (US), GDPR (EU), CASL (Canada), and other local regulations

3.2 Email Content

All pitch emails sent through our platform must:

• Contain truthful and accurate information about the sender and their music
• Include a valid reply-to email address
• Not contain misleading subject lines or deceptive headers
• Not contain malware, viruses, or harmful code

3.3 Rate Limiting & Fair Use

StreamProfy reserves the right to rate-limit or restrict accounts that engage in abusive sending patterns. Bulk contacts are subject to fair use policies.

4. Pitch Confirmations & Receipts

For your protection and ours:

• Every pitch sent through our platform generates a confirmation receipt
• Receipts include: date/time, recipient name (anonymized email), subject line, and delivery status
• Confirmation receipts are stored locally on your device and serve as proof of service delivery
• StreamProfy maintains server-side logs for a minimum of 90 days
• These records constitute proof that the service was rendered as agreed

5. Disclaimers & Limitations of Liability

5.1 No Guarantee of Results

5.2 Service "As Is"

The AI Pitch Tools are provided "AS IS" and "AS AVAILABLE" without warranties of any kind, either express or implied, including but not limited to implied warranties of merchantability, fitness for a particular purpose, and non-infringement.

5.3 Limitation of Liability

To the maximum extent permitted by applicable law, StreamProfy, its owners, employees, and affiliates shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including but not limited to:

• Loss of profits, revenue, or business opportunities
• Damage to reputation or goodwill
• Loss of data or information
• Any damages arising from use or inability to use the service

Total liability shall not exceed the amount paid by the user in the 30 days preceding the claim.

6. Contact Directory Data

• Contact information in our directories is compiled from publicly available sources
• StreamProfy does not guarantee the accuracy, completeness, or currency of directory data
• Contacts listed in our directories have not necessarily consented to receive messages from users
• Users are responsible for ensuring their outreach complies with applicable laws
• StreamProfy reserves the right to add, remove, or modify directory entries at any time

7. Intellectual Property

All AI-generated pitch content remains the property of the user who generated it. However, StreamProfy retains the right to use anonymized pitch data to improve the AI model. Users grant StreamProfy a non-exclusive license to store and process pitch data for service improvement purposes.

8. Account Termination

StreamProfy reserves the right to suspend or terminate access at any time, without prior notice, for:

• Violation of these Terms of Service
• Abusive, spammy, or fraudulent behavior
• Chargeback or payment disputes
• Any reason at StreamProfy's sole discretion

Upon termination, all credits are forfeited and non-refundable.

9. Modifications to Terms

StreamProfy may modify these Terms at any time. Continued use of the service after modifications constitutes acceptance of the updated Terms. Material changes will be communicated via email or platform notification.

10. Governing Law & Disputes

These Terms shall be governed by and construed in accordance with applicable law. Any disputes shall be resolved through binding arbitration, and users waive the right to participate in class action lawsuits.
